202 TOURISM LAW IN EUROPE 4.2.1. GENERAL PROVISIONS Presentation: The classification procedure has been applicable since 1 July 2010 in accordance with Article 22 of the Decree of 23 December 200979. 4.2.2. APPLICATION FOR CLASSIFICATION Stages: In order to obtain the desired classification, the operator must proceed in two stages: the visit of the inspection and then the submission of the classification application to Atout France. Pre-diagnosis and inspection visit: Initially, the accommodation provider sends the accredited inspection body, a pre-diagnosis in accordance with the model shown in the annex to the decrees laying down the standards and procedure for the classification of commercial tourist accommodation80. If the accommodation provider wishes to obtain the classification of his establishment, he must contact an accredited assessment body which appears on a list published and made available free of charge on the Economic Interest Grouping (EIG) Atout France website. This inspection firm carries out the visit and at the end of it issues a certificate to the operator with a favourable or unfavourable opinion on the level of classification requested, depending on compliance with the number of compulsory and “à la carte” points to be obtained. The certificate is issued by COFRAC (French Accreditation Committee) or any equivalent European body. 4.2.3. ROLE OF ATOUT FRANCE Time limit: Atout France has a period of one month from the date of receipt of the complete application file to pronounce the classification. This decision is taken after verification of the completeness of the file. Duration: Classification shall be granted for a period of five years81. The classification decision must indicate the name, address, INSEE number of the accommodation, its capacity and category.
