Wine Law

THE LABELLING AND PACKAGING OF WINE 197 Regulation (EU) 2019/33 of 17 October 201827, having regard to the abovementioned Regulation 1308/2013, acknowledged, among other, that rules of procedure concerning DOs and GIs in the wine sector were inconsistent with the rules applicable to quality schemes in the foodstuffs, spirit drinks and aromatised wines sectors of Union law. It has been the scope of the EU lawmakers to simplify, clarify, complete and harmonise, through Regulation 2019/33, the procedures concerning DOs and GIs in the wine sector. These are supposed to be modelled, as far as possible, on the efficient and well-tested procedures for protecting intellectual property rights relating to agricultural products and foodstuffs laid down in Regulations No 1151/201228, No 664/201429 and No 668/201430, and adapted to take account of the specificities of the wine sector. 2.1. Rules on the labelling of foodstuffs applying to the wine sector Chapter VI of Title III of Regulation No 479/2008 laid down the general rules for the labelling and presentation of certain wine sector products. Rules designated to cover foodstuffs finally applied to wine sector products, except where expressly excluded by the Directives concerned. It is worth mentioning the Directive 2007/45/EC of the European Parliament and of the Council of 5 September 2007 laying down rules on nominal quantities for prepacked products, as well as the First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks. These shall apply to every trademark in respect of goods, which is the subject of registration, or of an application in a Member State for registration as an individual trademark, a collective mark or a guarantee 27 Commission Delegated Regulation (EU) 2019/33 of 17 October 2018 supplementing Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards applications for protection of designations of origin, geographical indications and traditional terms in the wine sector, the objection procedure, restrictions of use, amendments to product specifications, cancellation of protection, and labelling and presentation. 28 Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs. 29 Commission Delegated Regulation (EU) No 664/2014 of 18 December 2013 supplementing Regulation (EU) No 1151/2012 of the European Parliament and of the Council with regard to the establishment of the Union symbols for protected designations of origin, protected geographical indications and traditional specialities guaranteed and with regard to certain rules on sourcing, certain procedural rules and certain additional transitional rules. 30 Commission Implementing Regulation (EU) No 668/2014 of 13 June 2014 laying down rules for the application of Regulation (EU) No 1151/2012 of the European Parliament and of the Council on quality schemes for agricultural products and foodstuffs.
