INTRODUCTION Montenegro is a small country on the Adriatic Sea, known for the diverse tourist offer, which ranges from stunning beaches to mountains, natural parks, historical and cultural monuments. Because of this and the favourable political and economic environment, Montenegro has seen an inflow of tourists and investments in the tourism sector. Montenegro is a member state of the United Nations World Tourism Organization (UNWTO) since 20072 and it is declared as the fastest growing touristic destination by UNWTO and European Tourism Commission in 20193. Tourism in Montenegro has exceptional potential, which can enable its further economic development and have a positive impact on the whole society. Tourism Law is a relatively new area of law, which regulates the conditions for performing tourism and catering activities, as part of the tourist offer, and other matters of importance for the tourism. It aims to provide a legal and regulatory framework for the development and management of tourism, preservation of cultural traditions, natural resources and to facilitate the involvement of the private sector and local communities in tourism development activities. Therefore, the purpose of Tourism Law in Montenegro is the development of tourism on the principles of sustainable development and the promotion of Montenegro as a global high-quality tourist destination and to provide new jobs and growth of living standards as a stable and reliable source for the state income4.
