Tourism Law in Europe

CZECH REPUBLIC | KLÁRA DVOŘÁKOVÁ 12 5 performs through a business agency and the other works on commission. The provisions of the Civil Code governing agency agreements will apply to their cooperation agreement. IV. CONCLUSION Tourism law is harmonised in the Czech Republic mostly following the Directive. The provisions on tourism can be found in several legal regulations, the most important one being the Tourism Act, which currently lays down the conditions for travel agencies, travel services intermediaries, tour guides, and also regulates the Mountain Rescue Service of the Czech Republic. If an amendment that is currently being prepared is eventually enacted, the Tourism Act will also comprise provisions on the activities of mountain leaders and mountain guides. The Czech Republic will thus have a “code” governing the key professions in tourism. For incoming travel operators, it is important to know that as of 1 March 2021, guides operating in the Czech Republic must have a special official licence for a 1st or 2nd degree tour guide, and guides from the EU, EEA or Switzerland may temporarily provide services in the territory of the Czech Republic under articles 56 et seq. TFEU, needing first to notify the Ministry for Regional Development, so as to provide a service in the Czech Republic’s territory for the first time.
