In conclusion, the processes of legal transformation promoted by the so-called sharing economy, in general terms, favours the commercialisation of areas of social life. On the other hand, however, the processes give priority to obtaining income from an asset of special transcendence for the development of life, such as housing. V. SHORT-TERM RENTALS THROUGH PLATFORMS AND UNFAIR COMPETITION A large part of the conflicts generated in the field of short-term rentals through platforms has been based on arguments of unfair competition. In a number of cases, established economic actors have invoked antitrust rules to oppose the way rentals are developed on Airbnb-type platforms. In this sense, and irrespective of the qualification finally granted to the lessor/host and to the platform, the legislation on unfair competition in Spain provides for its application both to entrepreneurs and professionals, as well as to any person participating in the market (Art. 3.1 LCD). One of the most problematic areas is that of pricing policies. Without question, the platforms and other companies operating in the digital market allow greater access to information on this and other issues. However, the acclaimed transparency of digital markets is not exempt from generating effects that may distort the proper functioning of the market. For example, according to Herrero (2018: 676), price transparency can favour collusive acts between competitors through the use of algorithms that detect deviations from competitors’ prices, periodically evaluating a set of factors in search of profit optimisation, which in turn allows them to constantly update their prices. In this way, they are in a position to react immediately to the commercial strategies of competition, with the ability to eliminate the expected effects or to coordinate, by agreement or autonomously, in order to maximise profits.
